MarketDial Celebrates Legal Win
A Utah software company, MarketDial, is cautiously celebrating after a federal judge dismissed a lawsuit that lasted six years against a subsidiary of Mastercard. Executives believe that many startups might not have survived such a legal battle.
The lawsuit, initiated by Applied Predictive Technologies (APT), claimed patent infringement and trade secrets violations. However, Utah District Court Judge Jill N. Parrish ruled that APT failed to specify which trade secrets MarketDial allegedly stole. APT provided extensive information about its operations but did not prove any proprietary claims.
“Simply stated, this court will not do APT’s job for it,” Parrish stated in her ruling.
The Impact of Litigation
MarketDial, which offers software that helps retailers test and measure changes, faced significant challenges during the lawsuit. Executives argue that APT's litigation was aimed at maintaining its monopoly in the market. Greg Osborne, MarketDial's VP of Operations, highlighted the personal costs of the lawsuit, stating that legal fees forced the company to lay off employees.
Ongoing Challenges
While the case has been dismissed, APT has filed an appeal and continues to assert that MarketDial wrongfully took its trade secrets. APT argues that MarketDial's co-founders had access to confidential information while working with APT. However, MarketDial insists that any information obtained was not confidential and that they built their software independently.
The Future Ahead
Despite the legal challenges, MarketDial aims to refocus on its mission of helping retailers grow. Co-founder Morgan Davis expressed optimism about moving forward, stating that the company can now concentrate on raising funds and expanding its customer base. “What we set out to do is help retailers... that’s the goal here,” Davis said.
MarketDial's journey underscores the resilience of startups in the face of legal adversity, showcasing the importance of innovation and determination in the tech industry.
